1. About CasaPrimes
CasaPrimes India Pvt Ltd ("CasaPrimes", "we", "us", "our") operates an online real estate marketplace that connects buyers, sellers, landlords and tenants across India. We are a technology platform and do not buy, sell, or rent properties ourselves.
2. User Eligibility
- You must be at least 18 years of age to register and use CasaPrimes
- You must have the legal authority to enter into a binding agreement
- Indian laws and regulations apply to all transactions facilitated through our platform
- We reserve the right to refuse service to anyone at our discretion
3. User Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials
- You must not share your account with any other person
- You are responsible for all activities that occur under your account
- Notify us immediately if you suspect unauthorised use of your account
- Providing false information during registration may result in immediate account termination
4. Property Listings
Users who post property listings agree that:
- All listing information (price, area, location, photos) is accurate and complete
- You have the legal right or authority to list the property
- Listings comply with all applicable laws including RERA regulations
- Misleading, fraudulent or duplicate listings are strictly prohibited
- CasaPrimes reserves the right to remove any listing without prior notice
- Commercial listings must include valid RERA registration numbers where applicable
5. Prohibited Activities
You agree NOT to:
- Post false, inaccurate, misleading or fraudulent content
- Harass, threaten or harm other users of the platform
- Collect other users' contact details for unsolicited marketing
- Attempt to bypass, hack or damage our platform's security systems
- Use automated tools, bots or scrapers without our written permission
- Post duplicate listings or spam content
- Charge users fees not agreed upon in the original listing
- Discriminate against users based on religion, caste, gender, or nationality
6. Fees & Payments
- Basic property listing is free for individual sellers
- Premium plans (Pro, Premium) are subscription-based with monthly or annual billing
- All fees are quoted in Indian Rupees (₹) inclusive of applicable GST
- Refunds are available within 7 days of purchase if no leads were received
- CasaPrimes uses secure payment gateways and does not store payment card details
- Failed payments may result in suspension of premium features
7. Limitation of Liability
CasaPrimes is a marketplace platform. We do not guarantee the accuracy of listings, the quality of properties, or the conduct of users. Maximum liability for any claim shall not exceed the fees paid by you in the preceding 3 months.
- We are not responsible for property transactions that occur off our platform
- We do not verify every listing and recommend independent verification
- We are not liable for loss of data, revenue or profits arising from platform downtime
- Use of the platform is at your own risk
8. Intellectual Property
- All platform content, design, logos and code are owned by CasaPrimes India Pvt Ltd
- Users retain ownership of photos and descriptions they post
- By posting content, you grant CasaPrimes a non-exclusive, royalty-free licence to display it
- You may not copy, reproduce or distribute our platform content without permission
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat. Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation for 30 days.
